1. Scope

1.1 These general terms and conditions (GTC) apply to all contracts and deliveries of goods that are concluded and take place via the online shop www.decoprint-3d.com, Dominik Schwab-Habith and customers who are consumers. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be assigned to either their commercial or independent professional activity.

1.2 Unless otherwise agreed, the inclusion of the customer's own contractual conditions is hereby rejected. 

2. Conclusion of contract

2.1 The product presentations and descriptions contained in the seller's online shop do not represent binding offers on the part of the seller in the legal sense, but serve to submit a binding offer by the customer. The customer submits an offer in the legal sense by placing the order.

2.2 After the customer has placed the selected goods in the shopping cart and has gone through the electronic ordering process, a legally binding contract offer for the goods in the shopping cart is made by clicking the "Complete order process" button. The confirmation of the receipt of the order takes place together with the acceptance of the order, immediately after sending, by an automated e-mail. With this e-mail confirmation, the purchase contract is concluded. The customer can also submit the offer to the seller by email (info@3ddecoprint.com) or by post (Dominik Schwab-Habith, Harla 12, 8453 St. Johann i. S.). If we refuse to conclude the contract, the customer will be informed immediately by email. When choosing external payment services (PayPal), the customer will be redirected to the external website of the respective payment service provider. The data relevant to the order are summarized again in an "order overview" before submitting the order. Here, the customer can check his details again and correct them if necessary before sending his order. By clicking on the "Submit & Pay" button. the customer submits a binding purchase offer for the goods selected by him.

2.3 The contract text, i.e. the customer's information on the order process, is saved by the DecoPrint-3D - Online Shop and can be viewed by the customer under the link "My Account" and under "My Orders". Regardless of this, we will send an order confirmation and these terms and conditions to the email address provided by the customer.

2.4 Only the German language is available for the conclusion of the contract.

2.5 The customer must ensure that the e-mail address given by him to process the order is correct so that the e-mails sent by us can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or third parties commissioned by the seller to process the order can be delivered.

3. Right of withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.

3.3 The right of withdrawal does not apply to the following contracts:

  • Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
  • The right of withdrawal does not apply to consumers who do not belong to any member state of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

4. Prices and terms of payment

4.1 Unless otherwise stated in the seller's product description, the prices given are total prices.

According to §19 Paragraph 1 UStG no sales tax is shown

Additional delivery and shipping costs can be viewed under "Shipping costs" on the seller's website or can be found in the respective product description.

4.2 Price errors reserved. If the correct price is higher, the customer will be contacted. In this case, a contract is only concluded if the customer wants to buy at the actual price. If the correct price is lower, this price will be calculated.

4.3 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which are to be borne by the customer. These include import duties or taxes (e.g. customs duties)

4.4 The payment options are displayed to the customer in the seller's online shop.

4.5 When paying by PayPal the payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, available at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full If the customer does not have a PayPal account, the conditions for payments without a PayPal account apply, which can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

4.6 When paying by Payment in advance you will receive our bank details immediately after placing your order.
We wait for the receipt of your transfer and deliver your order as soon as we have received your transfer. Please note that transfers (also online) take 1-3 working days and one working day must be added to our internal booking. We reserve the ordered goods for 10 days. After the reservation time has expired, the order will be deleted.                                                                                                                                               

5. Delivery and shipping terms

5.1 Unless otherwise agreed, delivery will be made to the address given by the customer. The delivery address given in the seller's order processing is decisive. We also deliver to packing stations. 

5.2Delivery takes place no later than 5 working days after receipt of payment, unless a different delivery time is specified in the item description or a different delivery time has been expressly agreed. We assume no responsibility in the event of delivery obstacles in the area of suppliers or manufacturers. If delivery or compliance with an agreed delivery time becomes impossible due to circumstances for which we are not responsible, we are entitled to withdraw from the contract in whole or in part. The customer will be informed of this immediately. Claims for damages are excluded in this case.

5.3 If the delivery of the goods fails for reasons for which the customer is responsible, he bears the reasonable costs incurred by the seller. This does not apply with regard to the costs of delivery if the customer has exercised his right of withdrawal in a timely and effective manner. If the right of withdrawal is exercised in a timely and effective manner, the provisions made in the seller’s cancellation policy apply to returns.

5.4 When collecting on site, the seller first informs the customer by email when the goods he has ordered will be ready for collection. The customer can then collect the goods on site (Harla 12, 8453 St. Johann i. S.) after consultation with the seller. 

5.5 Import duties when shipping abroad
For deliveries to countries of the European Union (EU) there are no customs duties. If necessary, however, additional customs duties, taxes and fees may apply when the goods are imported into countries outside the EU (e.g. for deliveries to Switzerland). All additional costs for customs clearance and other import and import fees are to be borne by the buyer. We have no control over these fees and we cannot predict their amount. As a small business owner according to § 19 UStG, we do not show sales tax for deliveries to other EU countries or third countries.

6. Reservation of title

6.1 The delivered goods remain the property of the seller until they have been paid for in full.

7. Liability for defects / warranty

7.1 If the purchased item is defective, the provisions of statutory liability for defects apply.

7.2 The warranty is excluded in the case of defects caused by the customer. This is particularly the case with improper handling, incorrect operation or unauthorized repair attempts. The shortened limitation period does not apply to damage caused by a grossly negligent breach of duty by DecoPrint-3D, Dominik Schwab-Habith. The shortened limitation period also does not apply to claims for damages due to the negligent or willful breach of essential contractual obligations. Essential contractual obligations are obligations, the fulfillment of which enables the proper execution of the contract in the first place and which the customer can regularly rely on to be observed.

    7.3 The customer is asked to complain immediately to the deliverer about goods delivered with obvious transport damage and to contact us as soon as possible. If the customer does not comply, this has no effect on the statutory or contractual warranty claims. Failure to submit a complaint or contact is only intended to support the provider in asserting his claims against the commissioned transport company or insurance company.

    7.4 If there is a manufacturer's guarantee, the customer has to assert the claims directly against the manufacturer. Our liability from the guarantee is excluded.

    8. Special conditions for assembly and construction work

    The following applies to the assembly or assembly of the goods:

    8.1 The seller provides his services at his option through qualified third parties selected by him. The seller can also use the services of subcontractors who work on his behalf. Unless otherwise stated in the seller's service description, the customer is not entitled to select a specific person to perform the desired service.

    8.2. The assembly and construction services relate exclusively to the goods offered in our online shop. The installation of products that are not offered by the seller will be refused.

    8.3 The customer can refer to the corresponding completion dates in the respective product description in the online shop and will be informed about them separately by email.

    9. Redeeming discount codes

    9.1 Discount codes can only be redeemed in the seller's online shop and only in the specified period. These are specified by the seller as part of promotions with a certain period of validity.

    9.2 Individual products can be excluded from the promotion.

    9.3 Only one discount code can be redeemed per order before the order process is completed. Subsequent billing is not possible.

    9.4 The discount will not be refunded if the customer returns the goods reduced with the discount code within the scope of his statutory right of withdrawal.

    10. Applicable Law

    10.1 The law of the Federal Republic of Austria applies to the exclusion of the laws on the international purchase of movable goods. 

    11. Alternative dispute resolution

    11.1 The EU Commission provides a platform for online dispute resolution on the internet at the following link: https://ec.europa.eu/consumers/odr

    This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

    11.2We are not obliged to take part in a dispute settlement procedure before a consumer arbitration board
